Kohl, Grassley Displeased With CMS Response On Sunshine Act Deadline

Sens. Charles Grassley (R-IA) and Herb Kohl (D-WI) on Tuesday (Nov. 1) expressed disappointment with CMS’ slim response to their query on why the agency has been delinquent in implementing regulations for a provision in the health reform law that requires drug and device makers to report any payments made to physicians. CMS Administrator Don Berwick issued a one-page response to their request last Friday — two weeks after the senator’s requested deadline — saying that the agency has been working to meet the goals of the Physician Payment Sunshine Act while minimizing the burden on the regulated parties, but does not offer a timeline for the regulations.

CMS’ response also comes after key industry stakeholders and consumer advocates wrote to HHS on Oct. 25 likewise urging the department to fully implement the reform law provision (see related story). HHS was required under the law to provide guidance on collection and reporting procedures by Oct. 1.
